Judge rules sexual experiences concerning rape will be allowed in 'War Machine' case

LAS VEGAS -- (KRXI) -- Christy Mack and the former MMA fighter known as War Machine faced off inside a Clark County courtroom today.

Mack was back on the stand Thursday answering questions about her sexual relationship with Jonathan Koppenhaver, also known as War Machine.
"I told him I had this fantasy and I had described where I would like it to happen,” Mack told defense lawyer Brandon Sua.
Sua, Koppenhaver's defense attorney, questioned Mack about simulated rape.
“You would want to simulate a rape scenario with Mr. Koppenhaver?” Sua asked.
“I had asked about that once to see if it was something he'd be interested with doing with me,” Mack replied.
War Machine's defense also asked his former girlfriend about a specific phrase she and Koppenhaver would say to one another.
“Do you remember? Do you recall stating to Mr. Koppenhaver that 'Real Men Rape'?” Sua asked.
“That was a joke between us,” Mack replied.
Sua also brought up the subject of choking during sex.
"I didn't specifically state choking,” Mack said.
“Is that what your intentions were?” Sua asked.
“To have him choke me? It depends on how I would be feeling at the time,” Mack replied.
The defense argued sexual testimony was necessary and the jury should hear every detail about the former couple's sexual experiences. After listening to Mack testify for about an hour, Judge Elissa Cadish ruled she would allow the testimony regarding rape but not choking.
"When the jury hears the testimony, when they fully understand the nature of the relationship, the request the sexual rape fantasies. They will fully understand the true nature of the relationship and with all the evidence I believe they will acquit Koppenhaver,” Sua said.
The state offered Koppenhaver a deal that would have sent him to prison for 16 years to life or 18 to 40. Koppenhaver rejected the deal.
The case is set for trial on Feb. 27.
