BROOKHAVEN, Miss. (TCD) -- A 57-year-old man and his 35-year-old son were re-arrested and charged with attempted murder 10 months after they allegedly chased and shot at a FedEx driver in their neighborhood.
According to the indictment cited by WJTV-TV, Brandon Gregory Case and his father Gregory Charles Case, who are white, were indicted by a grand jury on charges of attempted murder, conspiracy to commit first-degree murder, and shooting into a motor vehicle. The indictment alleges Brandon Case and Gregory Case tried to kill D’Monterrio Gibson, a Black man, by shooting at him.
WJTV reports Gibson dropped off a package at Gregory Case’s home on Jan. 24 at approximately 7:30 p.m. Gibson reportedly tried to get out of the driveway, and Gregory Case allegedly blocked Gibson's vehicle with his own pickup truck.
Gibson reportedly fled, then Brandon and Gregory Case got in Gregory’s pickup truck and chased Gibson. Brandon Case reportedly fired shots at Gibson’s truck.
According to NBC News, Gregory Case was arrested in February for conspiracy and Brandon Case for aggravated assault.
In February, Gibson and his attorney spoke about the initial charges against the Cases and said they were "not satisfied."
Gibson’s attorney, Carlos Moore, said, "Had the roles been reversed and Mr. Gibson had been accused of shooting at them, he would’ve been arrested that same night, charged with attempted murder, and put in jail and not allowed to bond out so easily."
Moore also referred to the fatal shooting of Ahmaud Arbery, a Black man who was fatally shot by a white father and son duo.
Moore said in February, "We just want to have a fair criminal justice system in Mississippi, and we want them fully prosecuted. Not only on the state level for the attempted murder, but also we want the feds to come in and look at prosecuting them for hate crimes similar to what was done in the Ahmaud Arbery case."
As for the updated charges, Moore told NBC News Gibson "will not take a full victory lap until the Cases are convicted of the crimes for which they have been indicted and both are in prison for their unlawful actions in regards to him on January 24, 2022."
