Judge denies motion to stop release of Brendan Dassey; orders release by 8 p.m. Friday

MILWAUKEE -- (WITI) -- U.S. Magistrate Judge William Duffin denied a motion on Wednesday morning, November 16 to stop the release of Brendan Dassey. The court also ordered that Dassey be released from the custody of the Wisconsin Department of Corrections no later than 8 p.m. on Friday, November 18.

Roughly an hour later, Attorney General Brad Schimel announced he will file an emergency motion in the U.S. Court of Appeals for the Seventh Circuit seeking a stay of this release order and requesting relief by Friday, November 18th.

Schimel on Tuesday asked that the order to release Dassey be put on hold. Schimel asked Judge Duffin to decide by Wednesday, November 16th at 4:00 p.m. because the state will also be filing an emergency motion in the federal appeals court. The state also filed an appeal of the judge's ruling ordering Dassey's release.

Meanwhile, the U.S. Probation Office has informed the court that it has approved the proposed residence of Dassey. The office has also completed all pre-release investigation it deemed necessary.

Dassey remains in prison at the Columbia Correctional Institution in Portage.

Dassey was convicted of helping his uncle kill a woman in a case profiled in the popular Netflix series “Making a Murderer.” Duffin has ordered his release while prosecutors appeal his overturned 2007 murder conviction.
