NAPLES, Fla. (TCD) -- A 35-year-old man was arrested this week after he allegedly pulled out a gun while waiting for his food because the order wasn't ready when he showed up.
According to Collier County charging documents, on Aug. 27, Matthew Davis went to Wingstop after submitting an online order that was reportedly supposed to be ready at 8:58 p.m. Davis reportedly went to the restaurant at 9:40 p.m. and was "unhappy that his order was not ready yet."
Surveillance video reportedly showed him "sitting and waiting" for his order, but he "gets more agitated" as time went on. Davis reportedly began "pacing impatiently," and a Wingstop employee handed him a cup for a free drink. The manager told a Collier County Sheriff's Office detective they "told him to help himself to any drinks from the fountain at no charge."
At 9:55, Davis' "agitation peaks" when he learned his food required even more time. He allegedly told two employees he was "going to get my strap," which is a slang word for gun.
He allegedly said, "They going to see that I'm not playing."
Davis allegedly "stands up and starts to get in the face of the employees" as his girlfriend attempted to restrain him.
Davis reportedly went back to his car, retrieved a gun, and walked back towards the Wingstop with the firearm in hand.
His girlfriend reportedly ran to him in the parking lot and told him to put the gun back in his car, and he eventually complied.
A couple and their 4-year-old child reportedly left an ice cream shop next to Wingstop the same time Davis reentered with his gun. One of the witnesses said Davis "had the black semi-automatic pistol down by his side and pointed forward, with his finger on the trigger."
The witness reportedly said Davis looked "serious."
The witnesses and their child reportedly ran to their car for safety and said they were "in fear" even though Davis didn't speak to them.
Davis reportedly told detectives the gun was unloaded and "his intention was to intimidate the witnesses, but did not intend to harm anyone."
He also said he was "stressed out" because his mother passed away a few weeks prior to the incident.
Collier County Sheriff's Office deputies arrested Davis Jan. 25 on two counts of assault with a deadly weapon. Records show he bonded out the next day.
