CPS requests lawsuit dismissal filed by parents over 8-year-old's suicide

CINCINNATI -- (WXIX) -- Cincinnati Public Schools has filed a motion to dismiss a lawsuit that was filed by the parents of an 8-year-old student after his death.
The parents of Gabriel Taye filed the suit against CPS in August claiming the district had disregarded acts of bullying directed toward their son, which led to the Carson Elementary third grader taking his own life.
CPS filed the motion on Friday, Oct. 6.
"As stated in the motion to dismiss, there is no question that Taye's death is tragic. The question raised by this suit is whether the Board and school administrators are responsible for it. A careful review of the complaint and the law shows that the defendants did not violate Taye's rights and did not cause his death or the corresponding suffering of his parents. As such, this action should be dismissed," Chief Communications and Engagement Officer Lauren Worley said.
Taye died on Jan. 26, just two days after he was assaulted and left unconscious on a restroom floor.
School security video from Jan. 24 shows a fellow student apparently hit the boy inside the restroom, according to an attorney for the victim's family.
